Acceptance of Terms

By accessing and using Smart Bookmark Manager (InsiteNest), you accept and agree to be bound by the terms and provisions of this agreement. If you do not agree to these terms, please do not use our service.

Service Description

Smart Bookmark Manager is an AI-powered bookmark organization tool that:

• Automatically categorizes and summarizes bookmarks
• Provides semantic search capabilities
• Stores and manages bookmark metadata
• Offers browser extension and web application interfaces

User Responsibilities

You agree to:

• Provide accurate information when using the service
• Keep your User ID and Installation Key secure
• Not use the service for illegal or unauthorized purposes
• Not attempt to access other users' data
• Not abuse or overload our systems

Intellectual Property

You retain all rights to the content of your bookmarks. By using our service, you grant us permission to process and store your bookmark data solely for the purpose of providing our services.

All InsiteNest software, features, and functionality are owned by InsiteNest and protected by international copyright, trademark, and other intellectual property laws.

Service Availability

We strive to maintain high availability but do not guarantee uninterrupted service. We reserve the right to:

• Modify or discontinue the service at any time
• Perform maintenance with or without notice
• Set usage limits or quotas

Limitation of Liability

To the maximum extent permitted by law, Smart Bookmark Manager (InsiteNest) shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use or inability to use the service.

This includes but is not limited to:

• Loss of data or bookmarks
• Service interruptions or downtime
• Inaccuracies in AI-generated summaries
• Third-party service failures (AWS, OpenAI, Pinecone)

Data Retention and Deletion

We retain your data as long as your account is active. You may request data deletion at any time by contacting privacy@insitenest.com with your User ID. Deleted data is permanently removed within 30 days.

What gets deleted: Bookmarks, processing jobs, profile information, URL cache, search embeddings, and all associated metadata.

Third-Party Services

Our service relies on third-party providers:

• OpenAI: AI summarization and categorization
• AWS: Cloud infrastructure and storage
• Pinecone: Semantic search capabilities

These services have their own terms and privacy policies. We are not responsible for their practices or service interruptions.

User-Generated Content

You are solely responsible for the bookmarks and URLs you submit to our service. You must not:

• Submit illegal, harmful, or offensive content
• Violate any intellectual property rights
• Share links to malware or phishing sites
• Attempt to bypass our systems or security measures

Service Modifications

We reserve the right to modify or discontinue the service at any time, with or without notice. We are not liable for any modification, suspension, or discontinuation of the service.

Termination

We may terminate or suspend your access to the service immediately, without prior notice, for any breach of these Terms. Upon termination, your right to use the service will cease immediately.

You may also terminate your use of the service at any time by ceasing to use it and requesting data deletion.

Indemnification

You agree to defend, indemnify, and hold harmless InsiteNest and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses arising out of your use of the service or violation of these terms.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions.

Dispute Resolution

Any disputes arising out of or relating to these Terms or the service will be resolved through binding arbitration, except that either party may seek injunctive relief in court to protect intellectual property rights.

Changes to Terms

We reserve the right to modify these terms at any time. We will notify users of any material changes by updating the "Last updated" date at the top of this page. Continued use of the service after changes constitutes acceptance of the new terms.

Severability

If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions will continue in full force and effect.

Entire Agreement

These Terms constitute the entire agreement between you and InsiteNest regarding the service and supersede all prior agreements and understandings.
